Organizing with IUOE In Canada
Joining a union is a protected democratic right throughout Canada under federal and provincial labour laws. It is your choice, and it is illegal for an employer to interfere with that decision. Employers may express opinions about unionization, but they may not use coercion, intimidation, threats, promises, or undue influence.
How Organizing Works in Canada
The process varies by province, but generally includes:
1. Signing Membership Applications
Signing a union membership application indicates you want IUOE representation. Signing does not automatically make you a union member. In some provinces, a small fee may apply.
2. Applying for Certification
Once enough employees have signed applications (the required percentage varies by province), the local union applies for certification with the appropriate labour board (Provincial or Federal Labour Board).
3. Certification
If a majority supports union representation, the labour board certifies the union. Depending on provincial law, certification may occur through:
- A card-based majority review
- A supervised employee vote
4. Negotiating a Contract
Once certified, the employer is legally required to bargain in good faith toward a collective agreement. Because labour laws vary by province, IUOE locals provide guidance specific to your location.
